This past September, the European Court of Human Rights had an opportunity to rule on the Dutch Supreme Court’s practice involving reserve judges. The Court did not take that opportunity. In Kuijt v. the Netherlands, the Grand Chamber declared the application inadmissible. It nevertheless emphasised that the serious concerns underlying the complaint warranted careful examination by the Supreme Court itself.

What next? Does this practice violate Article 6 of the European Convention on Human Rights? What does EU law require? Can the inadmissibility decision be regarded as an instance of judicial dialogue? How distinctive is the Dutch situation? Is it time to establish a statutory basis for this practice?

These and other questions will be explored at an ACCU/ACLPA roundtable featuring, among others, Tom Barkhuysen, Wendela Jacobs, Jasper Krommendijk, and Ulli d’Oliveira, who initiated the Strasbourg proceedings.
